Terms and Conditions of Sale

1. Seller Information

These Terms and Conditions of Sale govern all purchases made through the IndyArt Studio online store.

The seller is:

2. Scope

These Terms apply to all sales of products concluded through the IndyArt Studio website between IndyArt Studio and customers acting as consumers.

A consumer is an individual purchasing products for purposes that are mainly outside their trade, business, craft or profession.

By placing an order, the customer confirms that they have read and accepted these Terms, together with the Return and Refund Policy, Shipping Policy, Privacy Policy and Legal Notice.

The version applicable to an order is the version available on the website at the time the order is placed.

3. Products

IndyArt Studio sells original decorative art posters and prints.

The essential characteristics of each product are displayed on the relevant product page, including where applicable:

  • product design;
  • dimensions;
  • paper type and finish;
  • orientation;
  • whether a frame is included;
  • price;
  • production method;
  • estimated production and delivery information.

Unless expressly stated otherwise, all posters are sold unframed.

Photographs showing frames, furniture, interiors or decorative objects are mockups for presentation purposes only. Only the product described on the relevant product page is included in the order.

Customers should review all product information before placing an order.

4. Print-on-Demand Production

All posters are manufactured after the customer places an order.

Production and fulfilment are carried out by a specialised print-on-demand partner, including Printful, acting on behalf of IndyArt Studio.

The production location may vary depending on the delivery destination, product availability and fulfilment capacity.

Although production and delivery are subcontracted, IndyArt Studio remains the seller and the customer’s main contractual contact.

5. Product Appearance and Colours

IndyArt Studio makes reasonable efforts to display artwork, colours and product details accurately.

However, slight differences may arise between the digital image and the physical printed product because of:

  • screen calibration;
  • screen brightness;
  • colour profiles;
  • lighting conditions;
  • paper texture;
  • printing equipment;
  • normal production tolerances.

Minor variations of this nature do not constitute a defect.

This does not apply where the poster contains a significant printing error, is materially different from its product description or is otherwise not in conformity with the order.

6. Prices

Product prices are displayed in the currency selected on the website.

Prices are shown before the customer confirms the order. Shipping charges and any other applicable charges are displayed during checkout.

IndyArt Studio benefits from the French VAT exemption scheme:

VAT not applicable pursuant to Article 293 B of the French General Tax Code.

For international orders, import duties, import VAT, customs-clearance fees or other local charges may apply. Unless expressly collected at checkout, these charges are payable by the customer to the relevant authority or carrier.

IndyArt Studio may change its prices at any time. The price charged is the price displayed when the customer confirms the order.

Promotions apply only during their stated period and under their stated conditions.

Price information must be clearly provided before the customer places an order, and consumer-facing prices in France must generally be presented as the total amount payable.

7. Orders

To place an order, the customer must:

  1. select the desired product;
  2. add it to the shopping cart;
  3. verify the product, quantity and price;
  4. provide accurate billing and delivery information;
  5. select an available delivery method;
  6. choose a payment method;
  7. review the final order summary;
  8. accept the applicable terms and policies;
  9. confirm the order with an obligation to pay.

Before confirming the order, the customer can identify and correct errors.

An order is final once payment has been authorised and the customer receives an order-confirmation email.

The confirmation email summarises the essential elements of the purchase and serves as confirmation of the contract on a durable medium.

8. Refusal or Cancellation of an Order

IndyArt Studio may refuse or cancel an order where there is a legitimate reason, including:

  • payment refusal;
  • suspected fraud;
  • unlawful activity;
  • obvious pricing or technical error;
  • product unavailability;
  • delivery restrictions;
  • incorrect or incomplete customer information;
  • abusive or fraudulent conduct;
  • breach of these Terms.

If an order is cancelled after payment, the customer will be informed and the relevant amount will be refunded through the original payment method.

9. Payment

Payment is due in full when the order is placed.

Available payment methods are shown during checkout and may include payment cards, digital wallets or other services supported by Shopify Payments or third-party payment providers.

The customer confirms that:

  • the payment details provided are accurate;
  • they are authorised to use the payment method;
  • sufficient funds or credit are available.

Production normally begins only after payment has been successfully authorised.

Payments may be processed by independent payment providers and may be subject to their own terms and privacy policies.

10. Order Confirmation and Proof

Electronic records stored by IndyArt Studio, Shopify and the relevant payment provider may be used as evidence of:

  • communications;
  • orders;
  • payments;
  • transactions;
  • customer acceptance of the applicable terms.

Customers are encouraged to retain their order confirmation and invoice.

11. Production Time

Posters are normally produced within approximately 2 to 5 business days after payment confirmation.

This timeframe is an estimate and may vary because of:

  • high demand;
  • public holidays;
  • product availability;
  • technical issues;
  • temporary production delays;
  • circumstances outside reasonable control.

Production time is separate from shipping time.

12. Shipping and Delivery

Orders are delivered to the address supplied by the customer during checkout.

Delivery costs and estimated delivery information are displayed before the order is confirmed where available.

The total estimated delivery period consists of:

production time + shipping time

Detailed delivery conditions are available in the Shipping Policy.

The seller must comply with the delivery commitment stated in the contract. Where no specific date has been agreed, French consumer rules generally require delivery without undue delay and no later than 30 days after the contract is concluded, unless otherwise agreed.

13. Delivery Delays

If an order is not delivered within the agreed timeframe, the customer may contact IndyArt Studio and request delivery within an additional reasonable period.

If delivery still does not take place within that additional period, the customer may be entitled to cancel the contract under applicable consumer law.

Where the contract is validly cancelled because of late delivery, IndyArt Studio will refund the amounts paid within the legally required timeframe.

Estimated delivery dates may be affected by customs, carrier delays, weather conditions, strikes or other circumstances outside reasonable control.

14. Delivery Address

The customer must provide a complete and accurate delivery address.

The customer is responsible for checking:

  • recipient name;
  • street address;
  • apartment or building details;
  • postal code;
  • city;
  • country;
  • telephone number where required.

If an incorrect or incomplete address causes a failed delivery, return or additional shipment, the customer may be asked to pay the reasonable cost of reshipping, unless the error was caused by IndyArt Studio or its service providers.

Address corrections cannot be guaranteed after production has started.

15. Transfer of Risk

For consumer orders, the risk of loss or damage transfers to the customer when the customer, or a third party designated by the customer other than the carrier, physically receives the product.

Where the customer independently appoints a carrier that was not offered by IndyArt Studio, risk may transfer when the product is handed to that carrier, subject to applicable law.

16. Right of Withdrawal

Where applicable, consumers purchasing online have the right to withdraw from the contract without providing a reason within 14 days after receiving the product.

To exercise this right, the customer must send a clear statement of withdrawal to:

The request must be sent before the withdrawal period expires.

The customer may use the standard withdrawal form available on the website, but use of that form is not mandatory.

After notifying IndyArt Studio, the customer must return the product within 14 days.

The detailed procedure, return conditions and refund rules are set out in the Return and Refund Policy.

17. Return Costs After Withdrawal

Where a customer exercises the right of withdrawal for a simple change of mind, the direct cost of returning the product is borne by the customer, unless IndyArt Studio has expressly agreed otherwise.

The customer must be informed of this obligation before completing the purchase.

The product must be returned:

  • unused;
  • undamaged;
  • unmarked;
  • in its original condition;
  • appropriately protected for transport.

The customer may be held responsible for a reduction in value caused by handling beyond what is necessary to inspect the nature and characteristics of the product.

18. Refunds After Withdrawal

Following a valid withdrawal, IndyArt Studio will refund the payments received, including the cost of the least expensive standard delivery method offered, where required by law.

Additional delivery costs resulting from the customer choosing a more expensive shipping method will not be refunded.

The refund will be made using the original payment method unless otherwise agreed.

IndyArt Studio may withhold reimbursement until:

  • the returned product has been received; or
  • the customer provides evidence that it has been shipped;

whichever occurs first.

The refund will be processed within the legally applicable deadline.

19. Damaged, Defective or Incorrect Products

Customers must inspect their order after delivery.

Where a product is:

  • damaged;
  • misprinted;
  • defective;
  • materially different from its description;
  • different from the product ordered;

The customer should provide:

  • the order number;
  • a clear description of the issue;
  • photographs of the entire product;
  • close-up photographs of the problem;
  • photographs of the packaging and shipping label where relevant.

Where the claim is valid, IndyArt Studio may offer an appropriate remedy such as replacement, refund or another solution required by law.

The customer will not bear the necessary costs of bringing a genuinely defective or non-conforming product into conformity. EU consumer rules provide a minimum two-year legal guarantee for faulty goods.

20. Legal Guarantee of Conformity

Consumers benefit from the mandatory legal guarantee of conformity applicable under French and European consumer law.

A product must correspond to its description and possess the qualities that a customer may legitimately expect.

Where a lack of conformity exists, the customer may be entitled to a remedy such as:

  • replacement;
  • repair where appropriate;
  • price reduction;
  • cancellation and refund in cases permitted by law.

These statutory rights apply independently of any commercial guarantee or Printful claim procedure.

Nothing in these Terms limits mandatory consumer rights.

21. Hidden Defects

Customers may also benefit from the French statutory guarantee against hidden defects where the legal conditions are satisfied.

A hidden defect is a defect that existed at the time of sale, was not apparent and makes the product unfit for its intended use or substantially reduces that use.

The customer may exercise the remedies available under applicable law.

22. Lost Packages

A potentially lost package should be reported to IndyArt Studio within 30 days after the estimated delivery date so that a claim can be investigated with the fulfilment provider and carrier.

Customers should provide:

  • order number;
  • delivery address;
  • tracking number;
  • relevant carrier information.

Any replacement or refund will depend on the result of the investigation and the customer’s mandatory legal rights.

23. Packages Marked as Delivered

Where tracking shows that a package has been delivered but the customer cannot locate it, the customer should:

  • verify the delivery address;
  • inspect any safe delivery location;
  • contact household members or neighbours;
  • contact reception staff where applicable;
  • contact the carrier.

IndyArt Studio will provide reasonable assistance in investigating the matter.

The outcome may depend on carrier evidence, delivery circumstances and applicable consumer law.

24. Unclaimed, Refused or Returned Packages

Where a package is returned because it was:

  • not collected;
  • refused without a valid legal reason;
  • sent to an incorrect address supplied by the customer;
  • subject to unpaid customs charges;

the customer may be responsible for reasonable reshipping or reproduction costs.

Refusing delivery does not automatically constitute a valid exercise of the right of withdrawal. The customer must clearly notify IndyArt Studio of their decision.

25. Customs Duties and Import Charges

Orders shipped internationally may be subject to customs duties, import VAT, brokerage fees or other local charges.

Unless these charges are collected during checkout, they are payable by the customer.

IndyArt Studio does not control charges imposed by foreign authorities or carriers.

A customer who refuses a package solely because import charges are payable is not automatically entitled to reimbursement of all costs, subject always to mandatory consumer rights.

26. Exchanges

IndyArt Studio does not offer automatic direct exchanges.

Where a return is accepted, the customer may return the original item according to the applicable procedure and place a new order.

Damaged, defective or incorrect products may be replaced without requiring a new purchase.

27. Intellectual Property

All artworks and designs sold by IndyArt Studio remain protected by copyright and intellectual-property law.

Purchasing a physical poster gives the customer ownership of that physical copy only.

The purchase does not grant permission to:

  • reproduce the artwork;
  • scan or digitise it;
  • sell copies;
  • distribute it;
  • modify it;
  • use it commercially;
  • create derivative products;
  • mint it as an NFT;
  • use it for advertising or branding.

Any commercial or reproduction use requires prior written permission from IndyArt Studio.

28. Personal Data

Personal information is processed in accordance with the Privacy Policy.

Customer information may be shared with Shopify, Printful, payment providers, carriers and other service providers only where necessary to process payment, manufacture products, deliver orders, prevent fraud or comply with legal obligations.

29. Liability

IndyArt Studio is responsible for performing its contractual obligations in accordance with applicable law.

IndyArt Studio will not be liable for delays or failure caused exclusively by:

  • the customer;
  • an unforeseeable and unavoidable third party;
  • force majeure;
  • circumstances outside reasonable control.

Nothing in these Terms excludes or limits liability where exclusion or limitation is prohibited by law, including mandatory consumer-protection rights.

30. Force Majeure

Neither party will be liable for failure to perform caused by an event qualifying as force majeure under applicable law.

Such events may include natural disasters, war, civil unrest, major strikes, government measures, serious transportation disruption, epidemics, power failures or major production-network interruptions.

The affected party will take reasonable steps to limit the consequences.

The customer should provide their order number and a clear description of the issue.

32. Consumer Mediation

After first submitting a written complaint to IndyArt Studio, a consumer may refer an unresolved dispute free of charge to the consumer mediator appointed by IndyArt Studio.

33. Applicable Law

These Terms are governed by French law.

Where the customer is a consumer residing in another country, this choice does not deprive the customer of any mandatory protection granted by the law of their country of residence.

34. Disputes and Jurisdiction

The parties should first attempt to resolve any dispute amicably.

Consumers may use an applicable consumer-mediation procedure before commencing court proceedings.

Any legal proceedings may be brought before the court having jurisdiction under applicable consumer-protection rules.

No clause in these Terms requires a consumer to bring proceedings exclusively before a court located near IndyArt Studio.

35. Severability

If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions will remain in effect.

36. Changes to These Terms

IndyArt Studio may update these Terms to reflect legal, technical or operational developments.

The Terms applicable to an order are those accepted by the customer when the order was confirmed.

Changes will not apply retroactively to completed orders unless required by law.
