1. Overview

This website is operated by IndyArt Studio.

Throughout the site, the terms “we”, “us” and “our” refer to IndyArt Studio. IndyArt Studio offers this website, including all information, tools, products and services available through it, to you, the customer, subject to your acceptance of these Terms of Service.

By visiting our website, placing an order or purchasing a product from us, you agree to be bound by these Terms of Service, together with our Return and Refund Policy, Shipping Policy, Privacy Policy and any other policies referenced on this website.

These Terms apply to all users of the website, including visitors, customers and purchasers.

3. Products

IndyArt Studio sells original art posters and decorative prints.

The essential characteristics of each product, including its dimensions, materials, finish and whether a frame is included, are described on the relevant product page.

Unless otherwise stated:

posters are sold unframed;
images showing furniture, frames or decorative objects are mockups used for presentation purposes;
only the product expressly described on the product page is included in the purchase;
posters are printed on demand after an order is placed.

We make reasonable efforts to display product colours and details accurately. However, colours may vary slightly depending on screen settings, lighting, paper and printing processes.

Such minor variations do not constitute a defect unless the delivered product materially differs from its description or has a genuine production error.

4. Original Artwork and Intellectual Property

All artworks, illustrations, visual compositions, photographs, videos, branding elements, logos, texts and other content displayed on this website are owned by IndyArt Studio or used with permission.

Purchasing a poster gives the customer ownership of the physical copy only. It does not transfer any copyright, reproduction right, commercial licence or intellectual property right.

Customers may not reproduce, scan, copy, modify, distribute, resell, commercially exploit or create derivative works from our designs without prior written permission.

5. Eligibility to Purchase

By placing an order, you confirm that:

you are legally capable of entering into a binding contract;
you are at least the age of legal majority in your country or have the permission of a legal guardian;
the information you provide is accurate and complete;
you are authorised to use the selected payment method.

We reserve the right to refuse or cancel an order where fraud, unauthorised payment, abuse or unlawful activity is reasonably suspected.

6. Prices

Product prices are displayed in the currency selected on the website.

Prices include or exclude applicable taxes according to the customer’s location, the applicable tax rules and the information displayed during checkout.

Shipping charges, import duties, customs fees and other applicable charges are not included in the product price unless expressly stated. Any additional charges known at checkout will be displayed before the customer confirms the order.

For deliveries outside the European Union or other relevant customs territories, the customer may be required to pay import duties, local taxes or customs-processing fees imposed by the destination country.

We may change our prices at any time. The price charged will be the price displayed when the order is confirmed.

Any promotion or introductory price applies only during the stated period and subject to the stated conditions.

7. Orders

The presentation of products on the website does not constitute a legally binding offer.

Before confirming an order, the customer can review the selected products, quantities, delivery address, shipping method, price and applicable charges.

The customer is responsible for checking and correcting any errors before completing the purchase.

An order is considered accepted when:

the customer completes the checkout process;
payment is authorised; and
IndyArt Studio sends an order confirmation.

We reserve the right to reject or cancel an order in cases including:

payment refusal;
suspected fraud;
pricing or technical error;
product unavailability;
delivery restrictions;
incorrect or incomplete customer information;
violation of these Terms.

Where an order is cancelled after payment, the amount paid will be refunded through the original payment method.

8. Payment

Available payment methods are displayed during checkout.

Payment is due in full when the order is placed. Production will not begin until payment has been successfully authorised.

Payments may be processed by third-party payment providers. Their own terms and privacy practices may apply.

The customer confirms that all payment information supplied is accurate and that they are authorised to use the selected payment method.

9. Print-on-Demand Production

Our posters are produced after the customer places an order.

Production and fulfilment may be carried out by a specialised third-party partner, including Printful, acting on our instructions. The customer’s delivery information may be shared with the fulfilment provider only to the extent necessary to produce and deliver the order.

Although production is subcontracted, IndyArt Studio remains the customer’s seller and primary point of contact regarding the order. Shopify also states that merchants using dropshipping or fulfilment services remain responsible for complying with the rules applicable to retailers.

10. Shipping and Delivery

Orders are delivered to the address provided during checkout.

Estimated production and delivery times are provided for information only and may vary depending on the destination, carrier, customs procedures, seasonal demand and circumstances outside our reasonable control.

Unless a mandatory delivery deadline applies under consumer law, estimated dates are not guaranteed.

The customer is responsible for providing a complete and accurate delivery address. Additional costs caused by an incorrect, incomplete or undeliverable address may be charged to the customer.

lost parcels;
customs charges;
unclaimed deliveries;
incorrect addresses.

11. Transfer of Risk

For consumer orders, the risk of loss or damage generally transfers to the customer when the customer, or a third party designated by the customer other than the carrier, physically receives the product.

This does not affect any mandatory consumer rights.

12. Right of Withdrawal

Where applicable under consumer law, customers may have the right to withdraw from an online purchase within 14 days after receiving the product.

The conditions, procedure, exceptions, return costs and refund process are explained in our Return and Refund Policy.

Nothing in these Terms removes any mandatory statutory right of withdrawal. French official guidance confirms that distance-selling consumers generally benefit from at least a 14-day withdrawal period, subject to legal exceptions.

13. Returns, Refunds and Damaged Products

Returns, cancellations and refunds are governed by our Return and Refund Policy.

Customers must contact us before returning an item. Products must not be sent directly to a production facility unless we have expressly provided that address and authorised the return.

14. Legal Guarantee of Conformity

Customers benefit from any mandatory legal guarantees applicable in their country.

For consumers protected by French or European Union law, this may include the legal guarantee of conformity and the guarantee against hidden defects.

These statutory guarantees apply independently of any commercial policy offered by IndyArt Studio or our production partners.

Nothing in these Terms limits or excludes rights that cannot legally be limited or excluded.

15. Customer Responsibilities

Customers agree not to use the website or its content:

for unlawful or fraudulent purposes;
to infringe intellectual property rights;
to transmit malware or malicious code;
to interfere with the website’s operation or security;
to scrape, copy or commercially exploit site content without permission;
to submit false, misleading or abusive information;
to impersonate another person;
to make fraudulent claims or payment disputes.

We may restrict access to the website or refuse future orders where these Terms are materially breached.

16. Third-Party Services

Our website is hosted by Shopify and may use third-party services for payment, analytics, printing, fulfilment, shipping and other operational functions.

We are not responsible for the availability or content of independent third-party websites linked from our website.

The use of such services may be subject to separate terms. However, the use of a subcontractor does not remove any mandatory responsibility that IndyArt Studio owes directly to its customers.

17. Website Availability and Errors

We aim to keep product information, prices and website content accurate and available.

However, the website may occasionally contain typographical errors, technical issues, inaccurate information or interruptions.

We reserve the right to correct errors, update information or cancel an affected order. If an error affects an order that has already been paid for, the customer will be informed and refunded where appropriate.

18. Limitation of Liability

To the maximum extent permitted by applicable law, IndyArt Studio will not be liable for indirect, incidental or consequential losses arising from use of the website or products.

This limitation does not apply where liability cannot legally be excluded or restricted, including liability relating to:

death or personal injury caused by negligence;
fraud;
wilful misconduct;
mandatory consumer rights;
statutory product conformity obligations.

Nothing in these Terms excludes or limits rights granted by applicable consumer law.

19. Force Majeure

IndyArt Studio will not be responsible for delays or failure to perform caused by events beyond our reasonable control, including natural disasters, strikes, transportation disruption, customs delays, war, civil disorder, government measures, epidemics, power failure, internet disruption or failures affecting production and delivery partners.

We will take reasonable steps to reduce the impact of such events and inform affected customers where appropriate.

20. Personal Data

Personal data is processed in accordance with our Privacy Policy.

Order information may be shared with Shopify, payment providers, Printful, carriers and other service providers where necessary to process payment, manufacture products, deliver orders, prevent fraud or meet legal obligations.

22. Consumer Mediation

After first submitting a written complaint to IndyArt Studio, consumers may refer an unresolved dispute to the consumer mediator appointed by IndyArt Studio.

The mediator’s full contact details will be published here once the mediation agreement has been finalised.

23. Governing Law

These Terms are governed by French law.

However, where the customer is a consumer residing in another country, this choice of law does not deprive the customer of any mandatory protections granted by the law of their country of residence.

24. Dispute Resolution and Jurisdiction

The parties should first attempt to resolve any dispute amicably.

Consumers may use any mandatory mediation or dispute-resolution procedure available under applicable law.

Any dispute may be brought before the courts having jurisdiction under applicable consumer-protection rules. Nothing in these Terms requires a consumer to bring proceedings only before the courts located near IndyArt Studio.

25. Changes to These Terms

We may update these Terms to reflect legal, technical or operational changes.

The version applicable to an order is the version available when the customer confirms the purchase.

Material changes will not apply retroactively to orders already concluded unless required by law.

26. Severability

If any provision of these Terms is found to be invalid, unlawful or unenforceable, the remaining provisions will continue in effect.

27. Entire Agreement

These Terms, together with the policies referenced on the website, constitute the agreement between IndyArt Studio and the customer regarding use of the website and purchases made through it.
